To the extent Defendant seeks an order striking the declarations said motion is denied. To the extent Defendant seeks an order requiring Plaintiffs to file the missing declarations and granting Defendant leave to file a sur-reply so as to allow Defendant an opportunity to address both the missing declarations and the newly filed declarations, said motion is granted. Defendant has five (5) days from the date of receipt of the missing declarations within which to file said sur-reply.
