(DE 216). Plaintiff C.M.A. filed a response to the motion on August 7, 2009. (DE 256). No reply was filed and the deadline to file a response has passed. The Court has reviewed the motion, response, the Notice of Intent (DE 113 in 08-80811), and is otherwise fully advised in the premises. Defendant seeks an order striking C.M.A.’s Conditional Notice of Intent to Exclusively Rely on Statutory Damages Provided by 18 U.S.C. § 2255 (DE 113 in 08-80811) (“Notice of Intent”), filed June 5, 2009. Upon careful review, Defendant’s Motion to Strike is GRANTED. C.M.A.’s Notice of Intent (DE 113 in 08-80811) is hereby STRICKEN from the record. This Order is without prejudice to Plaintiff pursuing her arguments regarding the amount of damages to which she may be entitled.
