Page 3 of 4 4 motion is fully briefed and ripe for review. See DE’s 151, 168. The Court has carefully considered the motion, response, and reply, and is otherwise fully advised in the premises. The Court intends to GRANT Plaintiffs’ motion for an order for the preservation of evidence. However, Plaintiffs’ proposed order is overly broad. Accordingly, the Court directs the parties to attempt to agree upon language for an order directing Defendant to preserve evidence and submit an agreed order to the Court no later than July 20, 2009. If the parties cannot agree, then each party shall submit a proposed order by the foregoing date. In the interim and until further order of the Court, Defendant shall not destroy any evidence in his possession, custody, or control that is relevant to these cases or that may lead to the discovery of evidence relevant to these cases.
