Cheney Assistant Director/ eral Counsel SUBJECT: Misdemeanor Crimes, of Domestic Violence On September 30, 1996, Title 18, United States Code, Section 922(9)(9) was enacted, making it illegal for anyone who has been convicted of a misdemeanor crime of domestic violence to possess any firearm or ammunition. In December 1996, all employees authorized to carry a firearm were required to complete an inquiry regarding such convictions. For those who responded affirmatively to the inquiry, interim measures were taken which included' revocation of their authorization to carry firearms. Additionally, all applicants for law enforcement positions are now screened to ensure that they meet the full range of qualifications for positions in our facilities. The agency has closely reviewed the. legislation and evaluated its iMpact.on its operations. To accomplish the mission of the.Bureau of Prisons (Bureau), it is imperative that all Bureau employees are able to execute the. entire scope of their duties. As Title 18 prevents employees who have misdemeanor convictions of domestic violence from possessing firearms or ammunition, these employees are unable to perform the'full range of,their duties. This, in turn, substantially limits. the Bureau's.'ability to accomplish its mission.
