The request encompasses but is not limited to any videos of the 9th floor area in the proximity of his cell during the evening of August 9 through the time Mr. Epstein was taken out of his cell for the last time on August 10, 2019, or videos of the cell itself during that time period, records of the identities of (i.e. MCC employees or independent contractors or anyone else) who were on duty from midnight through 8 AM on August 10, 2019 or otherwise had access to the 9th floor unit where Mr. Epstein was incarcerated during this time period, records of any observations of Mr. Epstein on August 9-10, 2019, any and all photographs of Mr. Epstein or his cell taken on August 10, 2019, any and all electronic or tape recordings or records of any internal communications within the MCC or any external communciations by MCC staff on August 9 and August 10, 2019, records of any mental health interviews or assessements of Mr. Epstein at anytime during his detention, records of any decision to put him on or take Mr Epstein off suicide watch, photos of his cell taken on or before August 9 or on or after August 10, 2019, memoranda of interviews with any prisoners who were in Mr. Epstein's SHU unit on the 9th floor on or about July 23 or on August 9-10, 2019 relating to Mr. Epstein, the same request for interview memoranda of any MCC employee or independent contractor or any other person in the MCC midnight-8 AM August 10, 2019, any and all medical and EMS and hospital records from July 23 and/or August 10, 2019, and the future pathology and toxicology and medical examiner's reports. Additionally, we would request the preservation of any note or notes found in Mr. Epstein's cell on August 10, 2019, any ligature or other physical evidence related to his cause of death, any bedding, any medication or vitamins, any log showing who entered or were present in the MCC for the 12 hour period before 6:30 AM on August 10, 2019, as well as a list of inmates who were in Mr. Epstein's unit during the evening of August 9 and the morning of August 10, 2019. We would in addition to the preservation request ask for the production of all of the above. II. PRETRIAL DETENTION MCC New York staff are aware of the importance of the inst i t ut i on' s pretri a l detent i on mission . MCC New York staff are expect ed to act in a professi onal manner and are governed by a code of employee conduct . Attorneys who feel t hat the y have been treated unprofessional ly b y a staff member are asked t o put their complaint in wri ting t o the Warden's Office , MCC New York, 150 Park Row, New York, NY 10007 . All complaints will be looked into a nd app rop riate action will be taken if necessary. I n t urn, our staff apprec i ate t he p rofessiona l i sm a nd court esy expect ed from attorneys a nd other officers of t he court . Attorneys are expected not only to abide by the Attorney Gui de, b ut generally to act in a professional manner . In addition, all visi t ors are expected to refrain from using p rofanity and keep their voices a t a conversational level when speaking wi th staff, inmat es and ot her v i s i tors . All visi t ors , inc l uding attorneys , are prohib i ted from usi ng cell phones wi t hin the instituti on, including the lobby . All vis i t ors, i nc l uding attorneys , who viol ate MCC New York' s v i siting rules , create d i sturbances at t he insti tution or in any way jeopardize t he securi ty o r orderly operation of the instituti on may have thei r visiting privileges rest ricted or s u s pended . The informat i on contained in t his Guide i s meant t o be a general guideline and is not all- inclusive . We cannot envision every circumstance that c ould occu r , and thu s the Gu ide does not contain the a nswers to all questions . For example , i n the event of an institution emergency, security needs of the institution will overri de a ny porti on of t his Attorney Guide . A. Legal Visiting 1 . Visiting Hours Legal v i s i tat i on hours are as follows : Monday- Sunday (incl uding Federal Ho l i days) 8 :00 a . m. - 7 : 00 p . m. Visits during these hours do not need t o be scheduled in advance . Special legal visits outside of these hours may be requested through MCC New York' s Legal Department with a t least 24 hours notice (The Legal Department is open Monday-Friday 7:30 a .m. - 4 : 00 p . m. so a request for Monday must be i n by t he preceding Friday) . Requests shoul d be faxed to : "( 646) 836-7665, Attn : Legal Department ." Every effort wi ll be made to accommodate s uch requests , but final app roval is contingent upon t he Page 3 of 22
availabil i ty of staff . In the event an attorney requires an emergency v i s i t outs i de norma l l egal v i s i t ing hours a nd has not pre-requested i t , he/she must contact t he Operations Lieut enant . I f t here i s a ny probl em wi t h a l egal v i s i t during off duty hours, attorneys should ask to speak with the Institution Duty Officer or Operations Lieutenant . 2 . Attorney Proc e ssing MCC New York conducts a daily count of all inmates at 4 : 00 p . m., wit h an addit ional count at 10 :00 a . m. on Sat urdays , Sundays and federal hol i days . Addit iona l unschedu l ed counts may a l so occur in emergencies . During a count , inmates must be at their assigned c e ll or bu nk, unl ess t he i nmate has been authori zed to be in anot her area . In order to guarantee an accurate count , a request t hat an inmate remain i n t he visi t i ng room during t he cou nt must be made at least one hour before t he c ount , i . e . , 3 : 00 p. m. for t he 4 : 00 p . m. count and 9 : 00 a.m. for t he 10 : 00 a . m. count . When this approval is granted, t he inmate is placed on t he "out countn and will be required to remain in t he v i siting room u nt i l the count has been completed . I nmates who have not been p l aced on t he out count must terminate their l egal v i sits a half hour before the count beg ins , i .e., 3 : 30 p . m. and 9 : 30 a . m. Attorneys who arrive at the instituti on within an hour before t he start of a count , i . e ., after 3 : 00 p. m. or 9 : 00 a . m., will not be able to v i s i t their client until aft er the cou nt clears. Counts us ua lly take approximate l y 30-40 minut e s to c l ear . During t his t ime, a ll movement in t he inst i t u t ion ceases . Consequent l y , attorneys a nd/or t heir representat i ves wi ll not be a llowed t o enter or exit the Visiting Room during official counts . Visits should be scheduled accordingly t o avoid unnecessary delays . 3 . Ident ification To rece i ve attorney entrance pri v i l eges , a n indi v i dual must be abl e to establish h is o r her stat us as a n attorney by presenting i dentif i cation t hat verifies act i ve membership in any state bar. Excluding Legal Aid Society Federal Defender's, NY State Attorneys are required to have a Secure Pass Identification card for e ntrance . Upon notification that a NY State attorney is not in possession o f a Secure Pass , and upon approval from the Legal Depart ment , attorneys will be permi tted t o ent er t he i nsti tut i on for 60 days from t heir date of approva l wi t hout t he Secure Pass . I f an attorney i s l icensed in a state other than New York, he/she must contact the legal department at least 2 4 hours in advance so t hat their status as an attorney in good standing may be verified . Provided the Legal Depar t ment can verify the attorney' s s t a tus , t he attorney will be added on a list locat ed in t he lobby, authorizing the attorney's ent rance for a one year Page 4 of 22
period wi t h government i ssued p ict ure identification, such as a drivers l i cense . I t is u l timatel y the attorney's responsibility t o establ ish his or her membership in a State Bar . Aft er compl e t ing t he Notification t o Visit or form, attorneys must be processed t hrough t he meta l de t ect or, have t hei r hand stamped and s i gn t he bound l ogbook before being a llowed ent ry int o t he insti t u t ion . By signing the Not i ficat ion to Visitor forms, attorneys certify that they are not carrying firearms , explosives, weapons, ammunition, metal cutting tools, recording equ i pment , cellular phones, cameras, food items , narcotics, mari j uana, a l coholic beverages, prescri ption drugs or any other i t em deemed contraband . All l egal mat erial s and briefcases wi ll be searched for contraband a nd processed t hrough t he f l uoroscope. Handbags , newspapers, portabl e t e l ephones , a nd non- l egal mat erial s are not permi tted in t he Visit ing Room . Official Visitors: Federal employees , including Assistant U. S . Attorneys, l aw enforcement officers, U. S . Court official s , U. S . Probation Offi cers , a nd Ass i stant Federal Pub l i c Defenders , wi ll be permitted to visit upon presentation of appropriate identification . All visitors must present official identification, sign in and out of the logbook, and pass through the metal detector . 4 . Property Brought into the Visiting Room Legal Ma t erial An attor ney may bring i nto t he visiting room legal materials relat ed to a n i nmate's case, including CDs, or audio/videotapes as well as dollar bills for t he vending machines . An attorney (not a paralegal, investigator, mitigation specialist or int erpret er) will be authori zed to provi de a reasonabl e (not t o exceed four inc hes) amount of l egal mat erial s t o t he inmate at t he concl usion of t he attorney v i s i t . The inmate wi ll be a llowed t o take t hese l egal mat erial s wi t h him/ her t o his/her unit after the Officer determines the items are of a legal nature and he/she inspects them f or contraband . Legal materials should not be read for content b ut examined only to determine that they are indeed legal materials and t hey are free of contraband . Inmates housed in t h e Special Hous ing Unit (SHU) wi ll be a llowed t o take l egal mat erial s t o t heir unit minus fo l ders , papercl i ps , stapl es, rubber bands , or a ny other i t ems t hat coul d be cons i dered a security concern . Al l other materi a l s , incl uding cel lular p hones, pagers , newspapers, magaz i nes , t i ssues , wal lets and keys, are p rohibited and must be secured in a lobby locker before entering the secure confines of the institution . Addit iona lly , l egal v i deos , CDs and a udio tapes, cannot be provided t o an inmate during a l egal v i s i t b ut may be p l aced in t he Lobby l egal mai l drop box for de l i very t o t he inmate . Envelopes must be clearly marke d with the attorney' s name (inc l uding l anguage t hat i dent i f ies t hat person as a n attorne y ), inmate' s name a nd regi ster number a nd t he following statement : "SPECIAL MAIL-OPEN ONLY IN THE PRESENCE OF THE INMATE. Tape Pla yers , VCRs & Computers t o Review Discovery Ma t erial Due t o security concerns , attorneys may not bring electronic e quipment i nto t he secure confines of t he i nstitut i on . However, MCC New York has tape p l ayers , VCRs and t e l evisi ons fo r attorneys to rev iew discovery materia ls with clients in visit ing rooms . These items are available on a firs t come, first served basis b y oral request t o the visiting r oom officer . MCC New York also has a computer t hat attorneys may use to r evie w computer CDs with t hei r c l ients . The computer is availab l e during attorne y visiting hours and shou l d be res erved at least 24 hours i n a dvance b y cal ling t he Legal Departme nt . Attorneys who make an a ppoint ment to use the computer will have preference over those who do not make an appointment. Attorneys should bring a copy of the CD discovery when meeting with an inmat e . Audio a nd v i deo cassettes and CDs may also be mailed directly t o a n inmate v i a t he legal mail p rocedures explained below in the Legal Ma i l sect i on, Cl . I nmates may review their DVD a nd CD-Rom d i scovery materi a l as described in the Law Li brary Secti on, El . 5 . Private Conference Rooms The s e rooms are availab l e on a first come, first s e rved basi s . There are twelve conference r ooms i n the build i ng . Inst i tut i onal security and fire safet y regulations restrict t he tot al number o f peop le that may be in the visiting room a t any one t ime . Ultimat ely, i t is a correctional decision where any visit will take place . 6 . Mul tiple Cl ient Vi sits Attorneys are not limit ed in t he number of inmates t hey may visit in one day . However, only one inmate may be brought down to t he visit ing r oom a t any t ime . Please see below in Separat i on/Codefendant Meeting Section 11 for inst ruct i on on Co- Defendant Meet ings . When an a t torney has finished t he legal v i sit a nd the i nmate has be en s ent back to the unit , another inmate may be b rought d own to t he visit ing room . Page 6 of 22
Approved legal representatives (law clerk, paralegal , int erpret er, investi gator , psycho l ogist , and ot her experts ) may accompany a n attorney int o t he Visit ing Room . I f v i s i t ing independent l y , representat i ves must follow t he requirements set forth in t he " Legal Representati ves " section bel ow . See Sect i on 8 . Attorneys are ordinarily not permitted to bring material wi t nesses int o t he Visit ing Room . Pr io r approva l t o do so must be received from the Warden and requires a court order . Written requests for such approval should clearly outline the specific circumstances requi ring this type of visit . Visits will not be approved if alternative arrangements are available to defense counsel. 7 . Dress Code All visitors , including attorneys, are required to dress in a manner approp riate for a correctional environment . Excessivel y provocative , immodest or revealing attire is reason to deny v i siting . Visit ors over t he age of 12 wi ll not be allowed i nto t he insti t ution in short skirts , mini skirt s, short s or dresses exceeding three inches above the kneecap in length . See-through c l othing, halter-tops , t ube tops , tank tops , any top that reveals the midriff area, low- cut s hirts or blou ses , revealing front and/or backless clothing, skin- t i ght clothing, spandex clothing and sweat pants are not allowed . Furthermore, clothing which may impede identification (e . g ., hoods) or easily hide contraband (e.g., coats) present security concerns and are also prohibited . Al l visitors are required to wear shoes (no shower shoes, f l i p-flops , toe-revealing or backl ess shoes of any kind) a nd undergarments (including bras for femal es). The Warden has delegat ed to t he Institution Duty Officer the ultimat e decision- making authority regarding what attire is appropriate i nside t he Visit ing Room. If t he Duty Officer i s not available, the Operat i ons Lieutenant will make the final decision . A memorandum containing c l ot hing gui de l ines is posted in t he l obby of MCC New York . I t is t he responsibi l i ty of v i s i tors to fami l iarize t hemsel ves wit h t his memo a nd watch for updat es. 8 . Legal Representatives Attorneys are allowed to visi t their clients upon providing evidence of t heir professional status . However, attorneys often need other individuals , e . g., paralegal s , int erpreters , mitigation special ists , pri vate investigators , t o visit t heir c l i ents in connecti on wi t h legal representation . These individual s do not receive the same entry privil eges grant ed to attorneys and must first submit an application (See ATTACHMENT A) signed by a sponsoring attorney and pass a background check before being granted permission to ent er MCC New York . Once approved, t he indivi dual will be i nc l uded on a list maintained in the l obby and allowed to ent er the institution f o r one year with appropri ate government i ssued I D. The entry application may be requested from and mailed t o the Legal Departments of either MCC New York or MDC Brooklyn . Once approved the individua l may ent er bot h insti t utions. For mitigation specialist s, every time t hey visit the institution for a new inmate, t hey must submit a court order to t he Legal Depart ment which a uthorizes t hem to ent er the insti t ution t o visit wi th t hat specific inmate . Upon reapplying at t he end of their one year entry period, mit i gation speci a l ists a nd doct ors are required t o p r oduce a new order , reflecting t he new year . 9 . Pol ygraphs The Warden may permit polygraph tests in connection with state or federal criminal felony investigations. See 28 C. F . R. §551 . 71. Polygraph tests in connection with misdemeanor offenses, civil proceedings, o r any other matters are generally disapproved, absent a federa l court order . See I d . Requests for pol ygraph examinat ions mus t be submitted t o t he Legal Depart ment wit h approva l by t he Warden . The written request shoul d incl ude at l east t he following informat ion : (1) Inmate's name and register number; (2) Case caption, case numbe r and nature of matte r ; (3) Requested date and time ; (4) Expected l engt h of po l ygraph; (5) Name , t i t l e, a nd organizat ion of each person attending (all non- attorneys and non- l egal representat i ves will have t o fill out a n appl i cation so MCC can complete a background check (See ATTACHMENT B); (6) List o f all equipment to be used; and (7 ) Indication o f whether the inmate's consent has been obtained . The Warden must be abl e t o confirm t he va l i d i ty of t he request a nd t he inmate being examined must give written consent on a form provi ded for t hat purpose . Requesters are responsibl e for meeting all s tate and local requirements in administering the test . 10 . Depositions Requests for Deposit ions for state matters, both c i v i l a nd crimina l , mus t be submitted t o t he Legal Depar t ment for review . All depos i t ion requests must be made in wr i t ing a nd incl ude t he following information : (1) Inmate's name and register number; (2) A court order or similar court signed document for the Page 8 of 22
depos i t i on; (3) Case capt i on , case number and nat ure of matter; (4) Requested date and time ; (5) Expected length of deposition ; (6) Name, title, and organization of each person attending (all non- attorneys and non- legal representatives must fill out an appl i cation so MCC can compl e t e a background check (See Attachment B)); (7) Li st of a ll equipment t o be used; and (8) I ndication of whet her t he inmate ' s consent has been obtained . Video or tape recorders are not allowed inside the institution . Furthermore , all equipment is s ubject to inspection prior to ent ering t he inst i t ut ion. 11. Separat i on Assignments /Co- Defendant Meetings Co- defendant meet ings must be request ed at l east 24 hours i n advance of t he meet ing , e . g . for a meet ing on Tuesday at 2 : 00 P . M., the request must be submitted by Monday at 2 : 00 P . M. Written requests shou ld be faxed to the MCC New York Le gal Department , (6 46 ) 836- 7665 , and should include the names of everyone attending the meeting, including, b ut not limited to, attorneys , paral egal s , int erpret ers, invest i gators , co- defendants on bai l a nd co- defendants at MCC New York . Please ind i cate which attorney represents each inmate . Al so , p l ease inc l ude wit h t he request a copy of t he firs t page of t he ind i ctment showing t hat the requested parties are co- defendants . This must be provided every time a meeting is requested . Separation Orders : An inmate with a "separation order" is prohibited from coming in contact with the inmate from whom he or she is separated . Such a restriction would normally prevent a co- defendant meet ing . Telephone privileges are a s upplemental means of maintaining community a nd family ties that may contribute to an inmate ' s persona l deve l opment . However , l i mi tat i ons and condi t ions may be imposed upon a n inmate ' s t e l ephone pri v i l eges to e nsure adherence to other aspects of the Bureau ' s correctional management responsibilities . This form can be obtained from t he inmat e 's Unit Team . The Unit Counselor will t hen deliver one copy of that form to t he Receiving and Discharge (R&D) Department . The inmate will receive t he other copies of that form so that he may mail one t o the ind i vidual who wil l be dropping off t he court clothes . The individual bri nging t he clothing s houl d call R&D s taff in advance before dropping off clothes. Once authori zed, t hey must bring t he copy of the BP-331 form with t he package and notify t he lobb y officer who will contact a staff member from t he R&D department . The Burea u' s Administrat i ve Remedy Program i s a process t hrough which inmates may seek formal review of an iss ue relating to virtually any aspect o f their confinement , if informal procedures have not resolved the matter . See 28 C. F . R. Part 542 - Administ rat i ve Remedy; a nd Program Statement 1330 .1 3 , Administrative Remedy Program . This program applies as follows : (1) to inmates confined in institutions operated by the Bureau of Prisons ; (2) to inmates who are designated to contract Res i dent i a l Reent ry Cent ers (RRCs) , formally known as Community Correct ions Cent ers , under Bureau of Pr isons responsibi l i ty; and (3) t o former inmates for i ssues t hat arose during t heir confinement . The program provides for expedited investigations and responses in emergency situations, as well as extensions o f time for both filing grievances and receiving responses . If complaining about a sensitive issue, in the sense that the inmate's safety or well- being would be placed in danger if the request became known at the institution , the inmate may submit his administrati ve remedy d i rect l y t o t he appropr i ate Regiona l Direct or, marking " Sensit i ven upon t he reques t and expl a ining , in wr i t ing , t he reason for not submi tt ing t he request at t he inst i t ut ion . If the Regional Administrative Remedy Coordinator a grees that the request is sensitive, the request shall be accepted, investigated, and responded to . However, an inmate is not transported to a new institution immediately upon sentencing . The sentencing court must first provide to the USMS the final presentence investigation report and a signed j udgement and commitment order . The USMS must t hen forward t hese documents a l ong wit h a request for des ignat ion t o t he Designation a nd Sentence Computation Cent er (DSCC), l ocat ed in Grand Pra irie, Texas . When des i gnating an inst i t u t ion for an inmate t o serve a sentence , t he Bureau considers many factors , including b ut not limited to , the security level of the inmate, medical or psychiatric concerns and j udicial recommendations . Court Ordered Studies At anytime du ring an inmate's pre- trial confinement , the judge may order one of nume r ous studies fo und at 18 U. S.C . § 424 1 et seq . Once a j udge signs the request for designation , the court must send a copy to the USMS and Probation who will then contact DSCC . Since the inmate is not sentenced, he is not yet in Bureau custody , t herefore t he Bureau cannot make t he des i gnation without a n official reques t from t he USMS t o t he Bureau in Grand Pra i r ie. Neither t he Legal Department nor any inst i t ut ion staff have a ro l e in t he process . I t i s up to t he attorneys on t he crimina l case to make sure the order is processed as described in this paragraph . If questions arise, the attorneys may contact the DSCC (contact info . above) . H. Health Services 1. Si ck Call I nmat es are advi sed during t heir init i a l screening and phys i cal examinat ion t hat if t hey wi s h t o be eval uat ed by t he Heal t h Services Department , t hey must submi t a s ick call s l i p t o t he department . Sick call slips are available on the housing unit s and there is a sick call box on each unit in which to submit the slips . The sick call box on each housing unit will be emptied daily by a member of Health Services Staff and given to the medical staff for t riage . Requests will be priorit i zed in accordance wit h greatest medical need . I nmat es wi ll be charged a $2 . 00 co- pay fee for a ll non- c hronic care, non- emergent appoint ments . 2 . Emergency Care Any time there is a medical emergency on a unit , the inmate should notify the unit officer who can call the on- duty P . A. 3 . Medicat ion Wit h regards to medicat i on, MCC New York staff will make every effort to continue a n i nmate on a specific medicat ion as long as t he inmate has proof t hat he i s on t hat medicat ion (a prescription , a prescription bottle , etc . ) . However , for safety of staff and other inmates , there are several medications that an inmate may be on that are not on the national Bureau of Prisons formulary . In this instance , if medical staff find it necessar y to prescri be a substi t u t e medicat i on , t hey will do so . I f an inmate i s prescribed a medicat ion t hat has refills , i t i s t he i r responsibi l i ty t o not ify t h e p harmacy whe n t hey need a refill. Page 19 of 22
This can be accomplished by placing the empty bottle on the daily pill line cart that comes around to each housing unit at least once a day .
