Let me explain the reasoning behind the presentation in the memorandum. The lawyers discussed your point in the course of creating the document and decided on balance that we would gain credibility -- and therefore be more persuasive -- by addressing up front the context in which the legal issue arises. Also, I will have spoken with people before sending the memorandum so they won't be receiving it cold. My plan is to get people, during a conversation, past the point of reflexively turning away from the subject matter before sending the document.
