This document is an email exchange between Bruce A. Barket, an attorney from the firm Barket Epstein Kearon Aldea & LoTurco, and prison officials regarding the custody conditions of Nick Tartaglione.
The email, sent on September 1, 2020, expresses the attorney's deep concern for his client's safety. Barket alleges that Nick Tartaglione is being held in quarantine longer than permitted and is being forced into a dangerous cell tier under threat of being sent to the SHU (Special Housing Unit). The correspondence highlights a dispute over Tartaglione's placement and the potential risks he faces within the MCC (Metropolitan Correctional Center).

From: Bruce Barket <[email protected]> To: Cc: Aida Leisenring <aleisenring®barketepstein.com> Subject: RE: Quarantine Date: The, 01 Sep 2020 20:52:21 +0000 I just learned that he was being ordered onto another tier, where he does not believe he is safe. Worse, he was told that if does not enter the tier where he believes he is in danger he will be sent to SHU. This is deeply troubling. MCC has kept Mr. Tartaglione in quarantine for more than twice as long as he was supposed to be there and is now giving him the Hobson's choice of SHU or risking his safety. And, his most of his property is still in the old cell where you assured us he would be returned. I am again asking that he be placed on a safe tier, in a safe cell with a cellmate who does not pose a threat to him, preferably the cell where he has been detained for well over a year. Bruce A. As I wrote over the weekend, apparently the MCC refused to place Mr. Tartaglione back in his cell where he has been safe or in a unit of people over few years old. He is a retired police officer. As such he has been and is targeted for violence by other inmates. Prior to being housed with his current cellmate, Mr. Tartaglione was assaulted resulting in surgery and an extended stay in a hospital. For coming up on two years he has lived in a cell with a cellmate and has been relatively safe. He was removed—supposedly for 14 days—over a month ago from that cell and is now being forced to either stay in EFTA00032123
quarantine or be placed in a cell with a new cellmate where he may not be safe. We understood from you that he would be returned to the cell where he has lived in relative safety after quarantine. Can you please take the steps necessary to make sure Mr. Tartaglione is released from quarantine and placed in a cell that is safe? Thank you. Bruce A. Barket, Esq.
