See DE 334. Defendant’s motion argues that Plaintiff’s September 24, 2009 Appeal of the Magistrate Judge’s September 9, 2009 Order should be stricken as untimely filed. Accordingly, it is ORDERED AND ADJUDGED as follows: 1. Plaintiffs Jane Doe 2-8 shall respond to Defendant’s motion to strike on or before October 9, 2009. Plaintiff’s response shall be limited to providing the Court with authority to support the position that the appeal was timely filed. 2.
